DISCLAIMER AND INDEMNITY
10.1 EVEN though Infoscan endeavors to ensure the accuracy of all information it receives and disseminates through the Technology and Service, the user hereby specifically agrees that:
(a) Infoscan, its officers, employees, agents or anyone associated with it, shall not be held liable for any loss or damage resulting from any fault or delay in the delivery of the Service, or for any inaccuracy or omission no matter how such faults, delays, omissions or inaccuracies arise; and
(b) Infoscan shall in no way be liable for any loss, damage, or failure to perform any obligation due to causes beyond its control or from any circumstance it could not foresee or guard against; and
(c) under no circumstances shall Infoscan be liable for any indirect or consequential damages in respect of the Technology, Service or the information contained within them.
10.2 THE user hereby indemnifies and holds harmless Infoscan from and against any claim by any third party on the basis of loss or damage (financial or otherwise) caused to the Trialist or to any third party resulting from any inaccuracies in the Service and the Technology.
